Possession Orders

What is a possession order?

A landlord can apply to the court for an order to evict a tenant from a property, which is known as a possession order. When a possession order is obtained the court will order the tenant to leave the property by a specified date. Should the tenant not vacate the property in accordance with the terms of the possession order, a landlord can instruct enforcement agents to evict the tenant legally.

A possession order can be applied for by a landlord in circumstances where a tenant has breached terms of the tenancy agreement i.e. not paying rent or failure to repair the property or in the event that a notice seeking possession has expired and the tenant has not vacated the property.
